查看更多>>摘要：Based on Joseph Schumpeter's theory of"creative destruction,"we constructed a multi-sectoral endogenous growth model that integrates the agriculture,manufacturing,and service sectors.Employing numerical simulation,we investigated the dynamic influence of technological innovation on the industrial structural transformation in two key aspects:the level of innovation and the research and development(R&D)efficiency within industries.Our findings indicate that technological innovation plays a pivotal role in advancing industrial structural transformation.Enhancements in both the level of innovation and R&D efficiency within industries are instrumental in fostering industrial structural transformation.Specifically,the enhancements in the level of innovation or R&D efficiency within the agricultural sector hasten its transition toward the manufacturing sector,while such enhancement within the manufacturing sector expedites its transition toward the service sector.However,such enhancements within the service sector tend to decelerate the transition from manufacturing to service.In light of this,it is essential to harness technological innovation to enhance the level of innovation and R&D efficiency in industries to facilitate the transition of traditional industries into high-value-added and emerging ones.Meanwhile,tailored technological innovation strategies should be implemented to boost a balanced industrial structural transformation within industries.
查看更多>>摘要：A well-developed financial market system is crucial for supporting high-quality development in the new era.Initial Public Offerings(IPOs)are essential for enabling financial markets to facilitate new industrialization while accelerating the development of a manufacturing powerhouse.Therefore,research on IPO mechanism reform holds significant practical implications.This paper examines the impact of China's IPO mechanism reform by studying the equilibrium relationship between the primary market and the lending market.Using empirical analysis,we compare the average return on online subscriptions for newly listed shares using the risk-free rate before and after China's 2015 IPO mechanism reform,as well as analyze the underlying mechanisms driving excess returns during both periods.Our findings indicate a gradual alignment of returns in the primary and lending markets,with institutional arbitrage opportunities between them diminishing.The reforms have effectively enhanced market mechanisms,improved pricing capabilities,rationalized participant behavior,and optimized the securities market ecosystem.These improvements have contributed to the market's equilibrium and enhanced the market's ability to interpret information.However,further improvements to the IPO mechanism are necessary,including deeper market-oriented reforms,standardization of participant behavior,acceleration of a comprehensive registration system,and stronger information disclosure and quality management.
查看更多>>摘要：Using"catchphrases"as the keyword,this paper examines research literature(1995-2023)on catchphrases in China sourced from the China National Knowledge Infrastructure(CNKI).Utilizing CiteSpace for visualization analysis,it clarifies the current state of research on Chinese social catchphrases and identifies hotspots and evolution trends within the field.The findings reveal that the hotspots of research on social catchphrases in China involve text,discourse practice,and social practice,encompassing main research topics such as language structure,dissemination mechanisms,discourse meanings,and social mentality.However,current studies often focus on case analyses while ignoring the influence of macro social conditions on the production of catchphrases and neglecting the discourse production perspective regarding media events.Additionally,there is a lack of exploration of the subjects of discourse production.Future research should emphasize the long-term tracking of holistic research on catchphrases,focus on the intertextual influences between social context and the discourse production of catchphrases,place emphasis on the roles of Chinese mainstream media and digital media platforms in the discourse production and dissemination of catchphrases,attach importance to systematic investigations into the subjectivity of discourse production,and classify the research on the discourse governance of catchphrases as a key research field.

查看更多>>摘要：AI-generated images are a prime example of AI-generated content,and this paper discusses the controversy over their copyrightability.Starting with the general technical principles that lie behind AI's deep learning for model training and the generation and correction of AI-generated images according to an AI users'instructions to the AI prompt and their parameter settings,the paper analyzes the initial legal viewpoint that as AI-generated images do not have a human creator,they cannot apply for copyright.It goes on to examine the rapid development of AI-generated image technology and the gradual adoption of more open attitudes towards the copyrightability of AI-generated images due to the influence of the promoting technological advancement approach.On the basis of this,the paper further analyzes the criteria for assessing the copyrightability of AI-generated images,by using measures such as originality,human authorship,and intellectual achievements,aiming to clarify the legal basis for the copyrightability of AI-generated images and enhancing the copyright protection system.
查看更多>>摘要：The judicial application of digital evidence in criminal cases(criminal digital evidence)is an inevitable trend for the digital transformation of criminal proceedings in the macro context of the digital economy.It is characterized by digitization,diversification,and traceability.The application of criminal digital evidence can be divided into two main scenarios:the vertical scenario involving phases such as filing,prosecution,and trial;the horizontal scenario related to specific types of crimes.Criminal digital evidence is primarily applied to handling non-contact crimes,such as cybercrimes.However,the application of such evidence may infringe upon the basic rights of suspects,including their rights to privacy,rights to know,and rights to defense.Furthermore,the diversified and non-systematic nature of digital evidence may lead to challenges in applying the law,particularly with algorithmic"black boxes,"which can result in judicial discrimination and other drawbacks.Therefore,it is necessary to formulate or improve the regulatory framework for criminal digital evidence to ensure its lawful and standardized application.Additionally,judicial authorities must strengthen collaboration in case handling to ensure smooth coordination in collecting and applying digital evidence,thereby realizing its efficient litigation value.Furthermore,it is essential to check and balance the algorithm-based conviction and sentencing to protect the legitimate rights and interests of the parties involved,achieving high-quality human rights protection.
查看更多>>摘要：No consensus has been reached in the academic community regarding the principles and criteria for the application of substantive consolidation in bankruptcy.However,in judicial practices,the substantive consolidation doctrine has been applied to handle enterprise bankruptcy cases.This paper summarizes the dilemmas in the judicial application of substantive consolidation in bankruptcy through case analyses.The paper also proposes pathways for improving the judicial application criteria for the substantive consolidation in bankruptcy of affiliated enterprises in China,that is,comprehensively assessing the degree of corporate personality confusion from multiple perspectives;considering the cost and difficulty of asset segregation as supplementary elements;weighing the protection of creditors'interests;and taking into account the feasibility and necessity of consolidation and reorganization.
