    The Logical Transformation of the Modernization of State Governance

    查看更多>>摘要:The modernization of state governance embodies the process of modern state construction,and the success or failure of state governance depends on the institutional logic and effectiveness of state governance.The governance of modern Western countries is dominated by market logic and has made outstanding achievements in protecting individual rights and increasing material wealth.However,it faces a crisis of declining governance effectiveness.Since the Opium War,China's governance transformation has been deeply restricted by the traditional power-based logic and success has been hard.Since the founding of the People's Republic of China,especially since the reform and opening up,there has been a gradual shift from a power-based approach to a rights-based approach in state governance,which has achieved outstanding governance results.In view of the new changes in time and space,the modernization of state governance in the new era needs to deal with the dual tests of traditional factors and international situation.Therefore,the core issues of the transformation of state governance should be analyzed from an open-system perspective,and the logic of state governance should be effectively settled on the rights-based approach.In contemporary China,the most important thing in the modernization of state governance is to uphold the Party's leadership.From the perspective of practical issues and objective needs,the modernization of state governance must adhere to the people-centered principle,establish the foundation of governance by civil rights,build governance consensus through constitutional governance,create governance momentum through cooperative actions,and provide governance support through public virtues.This establishes and consolidates the base of the effectiveness of modern state governance and enhances its efficiency.

    Farmers Are Growing Further and Further from the Land:Land Transfer and the Practice of Three Rights Separation in China

    查看更多>>摘要:Over the forty years since reform and opening up,China's rural land system has undergone a drastic transition from the Two Rights Separation to the Three Rights Separation.Any examination of the latter must be grounded in the crucial field of land transfer.Our fieldwork in different areas across China revealed that the rapid development of industrialization and urbanization has driven a drastic increase in the intensive,large-scale transfer of land.As a result,the traditional small-farmer economy is disintegrating,accompanied by a widening distance between farmers and the land.In practice,the Three Rights Separation system exhibits some new characteristics:the growing substantiation of the ownership rights of the village collective,the demutualization of the contracting rights of farm households and the marketization of management rights.At the same time,in practice we have also seen a strengthening of the position of those enjoying ownership rights and management rights and a weakening of the position of those possessing contracting rights.To change the rural land system and accomplish its goal of rural revitalization,China must endeavor to construct a new type of collective market economy.

    查看更多>>摘要:Early Chinese villages and cities were born simultaneously from primitive settlements and existed side by side.As a significant part of China's early social structure,they should be regarded as an important marker of the origin and development of Chinese civilization.The early villages were mainly clustered settlements that were under the rule of cities from the day they came into being.Villages and cities usually formed a single community,and their relations were essentially patriarchal and political.The early villages were mainly patriarchal clan organizations which were overlaid by geo-administrative organizations in the Spring and Autumn and the Warring States periods.The mainstay of basic village organization thus became the household registration of the common people.

    Women's Political Status and the Sex Ratio at Birth:An Empirical Study Based on 1950-2020 County-Level Data

    查看更多>>摘要:Women's emancipation is an important part of the people's liberation movement led by the Communist Party of China.Improving women's political status is the basic condition for improving their social welfare rights and interests.Based on the data from county gazetteers covering more than 1,700 counties,the censuses of 1990 and 2000,and other representative surveys,we conducted an empirical study on the long-term effect of women's political status on the sex ratio at birth.Our research found that the higher the ratio of female Communist Party members in each county in 1950,the more normal was the sex ratio at birth in the following 50 years.The improved political status of women aged 16-20 significantly raised the proportion of girls among surviving children,especially in the era of family planning.This demographic study provides empirical historical evidence for the first time on one aspect of the long-term social impact of the mission of the Chinese people's liberation.

    查看更多>>摘要:During the past forty years of reform and opening up,China's private economy has made remarkable strides.This paper introduces start-up organizational processes into the study of elite mobility in emerging markets,exploring the relationship between the social origins of entrepreneurs and their entrepreneurial outcomes.Our research finds that the initial scale,growth rate and current size of enterprises established by elite entrepreneurs are larger than those of grassroots entrepreneurs.With the deepening of economic reform and the growth of the private economy,the social origins of large business owners generally tend to be elitist and the scale advantage of the enterprises set up by elite entrepreneurs,especially endogenous or inside-track entrepreneurs,is ever more striking.The expansion of such enterprises' superior position is mainly due to their initial advantages of scale;after the start-up period,the advantage conferred by their pace of growth does not increase synchronously.In order to promote the further development of the private economy and release its innovative potential,it is necessary to give full play to the government's function of regulating market operations and correcting market failure,and thus actively creating a good business environment.

    Construction and Interpretation of Fundamental Legal Concepts:With a Focus on the Relations between Right and Power

    查看更多>>摘要:Fundamental legal concepts can be identified empirically,but they need to be justified logically.The formal deduction of fundamental legal concepts can be achieved by the integration of Hohfeld's theory and logical method.Fundamental legal concepts should be defined and expressed as follows:right,duty,no-right,no-duty,power,liability and no-power,no-liability,and their relations should be specified as relations of external negation,correlation and classification.The substantive construction of fundamental legal concepts needs to fill the gaps in Hohfeld's theory and ground fundamental legal concepts in certain legal thought.Given the mutually interpretive relations between legal thought and particular types of legal norms,as carriers of concepts in the "right" and "power" groups,legal norms can be classified as two types related to legal thought.The theory of the object of right,and especially the fact that the right therein can become the object of right,lays a foundation for interpreting the relation between right and power.In structural terms,right and power have a nested relation;in terms of properties,their relation is one of contradiction;functionally,it is one of means and end;in terms of amounts,it is one of equivalence;and in terms of logic,it is one of mutual priority.As the fulcrum of fundamental legal concepts,the dual structure of right-power has not only inspired theories relating to the types and nature of right but also provided modern jurisprudence with an interpretation of two-order construction of the concepts of law,the legal system and legal order.Its theory of practice rests on the fact that it offers a micro-mechanism shared by all forms of governance.

    On the Legal Attributes of Digital Currency

    查看更多>>摘要:Digital currency has been widely used ever since the concept of Bitcoin was formulated.It uses blockchains as its underlying technical support and is characterized by decentralization,programmability,and security verification based on the principles of cryptology.Generally speaking,theories on the legal attributes of digital currency regard it either as non-monetary property or as currency.The former theory can be subdivided into theories on digital currency as commodity,as securities or as data.All of these subdivisions present insurmountable theoretical difficulties and practical obstacles.If we return to the substantive nature of currency as a generally accepted accounting symbol,it can be seen that currency issuance by the state or a private bank is simply a means of building currency credit rather than a necessary condition.Unlike traditional currency,digital currency relies on blockchain technology to complete the construction of decentralized currency credit.This has resulted in a new theory of currency based on the theory of digital currency.On the one hand,it offers a jurisprudential foundation for the construction of the quasi-currency attributes of digital currency;on the other,it provides a theoretical basis for the gradual improvement of digital currency legislation.We can first determine the legal attributes of digital currency as a quasi-currency and then confirm its legal position when the time is ripe.We need to confirm the legal status of digital currency as a quasi-currency through legislation,and use this as a logical starting point for the construction of a series of legal systems for digital currency as a quasi-currency.Digital currency can easily be used as a tool for crime or for evading financial controls;therefore,we need to determine a regulatory body and formulate regulatory rules.

    查看更多>>摘要:Today,constructive journalism continues to develop globally and is flourishing in China.This paper analyzes the distribution of constructive journalism research,media exploration and journalistic practice during the COVID-19 pandemic in China on the basis of tracked observations,research and interviews,and cooperation pilots;outlines the structure and changes of journalism,especially audiovisual journalism,in China from a "constructive"perspective;and provides a comprehensive overview of constructive journalism research and practice in China.It aims at considering the relationship between journalism,the media and society in the new environment and providing reference material for the development of constructive journalism and Sino-Western dialogue.The study finds that constructive journalism is not only an important concept in the development of Chinese journalism,but also a journalistic practice with deep roots.Since the beginning of the 21st century,incremental progress has been achieved,marked by the keywords of people's livelihood,lending a hand,"questioning officials",and construction.Constructive journalism is becoming a means and a channel for media participation in social governance,as was clearly shown during the COVID-19 pandemic.
