The Sinicization of Hermeneutics:A Universal Conception of Classical Hermeneutics

    Hong HandingHuang Deyuan
    24-42页
查看更多>>摘要:We need to start from the approach to classical annotation ofjingxue (Confucian classical studies),with its long history and experience, and to make use of the fine resources of contemporary Western hermeneutics,so as to build a universal classical hermeneutics that will bridge Chinese and foreign thought in the past and the present. This is a necessary path to opening up and innovating China's fine traditional culture. To carry out this important academic project of universal classical hermeneutics,it is necessary to gain an in-depth understanding of the developmental history of Western hermeneutics and contemporary philosophical hermeneutics, and especially to fully grasp Gadamer's hermeneutical thought and theories and their contemporary development. In addition,it is necessary to comprehensively organize the vast experience and long history ofjingxue and its branches, such as exegesis, textual studies, philology, bibliography and hermeneutics, and to take the modernization ofjingxue as a starting point for establishing a type of universal classical hermeneutics that is different from traditional Chinese jingxue but also superior to Western hermeneutics.Only in this way can we base ourselves on China, learn from foreign countries, excavate history and grasp the contemporary,so as to fully reflect the "Chinese style and manner" and characteristics in disciplinary, academic and discourse systems.

The Organizational Working Conditions from a Governance Perspective:An Analytical Framework

    43-57页
查看更多>>摘要:To pursue high-quality development,China needs to create new working conditions for workers to improve the quality of their work."Working conditions" refers to the kind of working climate and state that people perceive in their organizations,a perception will have an important impact on their organizational behavior.Improving the working conditions of an organization is actually a social process of organizational govemance. In observing organizational working conditions from a governance perspective,it is necessary to take into consideration "embeddedness" as a structural background and the work unit (danwei)as an institutional vehicle. It is imperative to emphasize both organizational order and the subjective perceptions of individuals. It also essential to analyze the organization's social solidarity, its conflicts and integration and its protections and inclusion, the participation of its members, their interaction and the structure of their roles, and the organization's structure and functions. This analytical framework provides a more comprehensive picture of organizational governance, which in turn reflects the organization's working conditions and provides insights into overall research and dialogue in the disciplinary field of working conditions.

Reconstructing the Principle of Nullum Crimen Sine Lege

    Gao WeiShao Ya'nan
    58-73页
查看更多>>摘要:As a product of scientism and rationalism, the principle of nullum crimen sine lege has been subject to changing times and theoretical assumptions. In practice, therefore,it has not been fully able to play its role in protecting freedom and has constantly wavered over the determination of criminal punishments.Even though it has been constantly challenged, the principle of nullum crimen sine lege should be adhered to and renewed as an important principle of the modem rule of law.First, the principle of de lege lata is being questioned by theories of substantive law,and sources not in the form of law have become the de facto basis of criminal punishment. For this reason,it is necessary to reaffirm the nature of de lege lata as an exclusive source of law.Second, although the possible boundary of the meaning of criminal law texts cannot be clearly delineated empirically, one should not therefore reject the possible boundary of this meaning. The practice of delineating an objective boundary based on empirical facts should be abandoned and normative boundaries should be delineated and justified. Finally, the responsibility for judicial clarity should be recognized and accepted as a supplement to legislative clarity, and a two-tier system of legislative and judicial clarity should be developed. Here, the definite nature of criminal legislation should develop standards in terms of behavioral guidance and judicial restrictions, and clarity in criminal justice should start from the legislative text and establish general secondary rules to make the text more specific, bringing it ever closer to specific and particular case facts, and eventually establishing a relationship of subsumption between the legislative text and the facts of the case.

Changes in Disease Patterns in Rural China,With an Explanatory Framework

    Yu ChengpuLi Guanghui
    74-95页
查看更多>>摘要:Data on the disease pattern in rural China over the past hundred years show that chronic diseases have now replaced infectious diseases as the major health problems plaguing rural residents. From the perspective of life-course research, taken together with medical anthropology's emphasis on bio-sociocultural integrity,we can divide chronic diseases into two:the chronic diseases of excessive depletion and the chronic diseases of excessive intake. The former are mainly the result of societal experiences engraved on the body;chronic diseases represented by arthritis and intervertebral disc disease are the marks left on the human body by the "hard times" of the early years. The latter is the result of the transformation of working life in which the abundance of material resources and the reduction of physical exertion occur simultaneously;the rapid arrival of the "good times"mean that bodies that have long suffered from hunger and exhaustion find it hard to adapt.Hypertension and diabetes are the physical manifestations of this distress.Fundamentally, chronic diseases falling into the over-intake category may appear to originate from the sweetness of current life, but they are in fact the physical reproduction of earlier experiences. Our village case study fleshes out this explanatory framework, allowing us to see the complex relationship between social institutions, livelihood patterns, cultural mindsets, bodily habits, and disease.

China's Inclusive Public Finance System:Based on an Examination of Irregular Revenue

    Lü WeiWang WeitongGong Huayan
    96-115页
查看更多>>摘要:China's achievement of miraculous economic growth is a theoretical proposition that calls for an explanation. The key to understanding the logic of China's economic reform is a rational explanation of the logical paradox between irregular local finance and the incentive compatibility of central and local governments.Based on the fact that autonomous local financial resources have long been dependent on irregular fiscal revenue, this paper constructs an inclusive public financial system analysis framework from the dual perspectives of the central and local government. This analytical framework offers an explanation of the long-standing implicit fiscal decentralization contract in which irregular fiscal revenue is the carrier in the reform process, together with a description of the central-local interaction process and institutional space underlying the behavioral motivations of central finance tolerance and local financial autonomy. It demonstrates the logical consistency of irregular fiscal revenue, central and local incentive compatibility, economic growth and market-oriented reform. The inclusive public finance system, which takes into account both local dynamism and central control, provides the important institutional logic that has enabled China to reach the dual goals of economic growth and market-oriented reform.

Changes in the Economic Structure and Trends in China's Future Energy Demands

    Zheng XinyeWu ShimeiLi FanghuaGong Huayan...
    116-137页
查看更多>>摘要:The scientific evaluation of trends in China's future energy demands is highly important.Using provincial-level panel data from 1995 to 2015,we studied the relationships between the economic aggregate, the development of energy-intensive industries and energy demand from the perspective of changes in the proportion of energy-intensive industries in the national economy. We find that economic aggregate affects energy demand through energy-intensive industries and that changes in the economic structure are the key factor for change in energy demand. This means that China's future energy demand will be much lower than that contained in forecasts that did not consider this factor.Comprehensively promoting green-tech development and strengthening the regulation of energy-extensive industries will be one of the key options for realizing China's obj ective of controlling total energy consumption.

China and the Reform of International Trade Governance System

    Dong YanLi ChundingHuang Deyuan
    140-164页
查看更多>>摘要:The 21st century has carried the international trade governance system into a period of accelerated reshaping. The reform has been fueled by many factors including the requirement of the in-depth development of global value chains for cross-border institutional coordination, the requirement of the form of digital economy for new digital rules, and the requirement of the dominant countries under the traditional international trade governance system for the maintenance of their own interests. The reform of international trade governance system has driven China to adjust itself to external pressures while creating opportunities for the country to deepen the reform and join international trade governance.China as a beneficiary and firm supporter of economic globalization has rapidly grown from a marginal participator in economic globalization into a builder and contributor of the governance of the international trading system. It plays an active part in the reform of international trading system and the construction of a community of shared future for mankind by means of the making of rules, the reshaping of rules, the adjustment of rules, and the adaptation to rules. In addition, the critical measures for China to cope with the changes of globalization also consist in its deepened domestic reform, proactive opening-up,facilitated alignment with domestic and intemational rules, and an institutional environment suitable for the new situation of a "dual circulation" development pattern.

East Asian Regional Cooperation Network and China's Path Choice

    Dong HeLi Guanghui
    165-187页
查看更多>>摘要:The current East Asian regional cooperation framework is a complex system with multiple fields, levels, and players. In terms of social network theory and analysis, the East Asian regional cooperation framework can be defined as an affiliation network of cooperative mechanisms and players.Combing through the process of East Asian regional cooperation and constructing an East Asian regional cooperation network on the basis of the affiliation network model shows that the network has distinct characteristics in terms of cooperation mechanisms, cooperation entities,inter-entity relations, and the interaction of various fields of cooperation. These characteristics are apparent in concentrated form in the dynamics and limitations of East Asian regional cooperation networks.Describing and analyzing the structure and characteristics of the regional cooperation network of the Association of Southeast Asian Nations (ASEAN) can help us conduct a comprehensive examination of the current regional cooperation framework, grasp the developmental prospects of East Asian regional cooperation, and provide reference material for China's path choice in the process of future regional cooperation.
