摘要
随着社会经济的发展,人们对林业生态环境的重视程度日益增加,林业生态损害赔偿问题也引起了学界和实务界的更多关注.然而,目前我国林业生态环境损害赔偿实践中仍存在处理相关问题的法律体系不健全、损害价值评估不准确、环境侵害责任难认定等问题.对此展开探索和研究,针对性地提出召开听证会、建立损害赔偿协作机制、咨询专家学者、通过走访办案部门了解实际问题等方法,力求解决林业生态环境损害赔偿办案中遇见的重点和难点问题,为生态环境损害赔偿实践提供理论和技术支持.
Abstract
With the development of social economy,the issue of forestry ecological environment damage is becoming increasingly apparent,which has attracted numerous attention from the academic and practical fields.However,there are still problems in the current practice of compensation for forestry ecological en-vironment damage in China,such as an incomplete legal system for dealing with compensation,inaccurate assessment of damage value,and inadequate environmental infringement liability.Therefore,this paper put forward some targeted suggestions,such as holding hearings based on practical issues,establishing a col-laborative mechanism for compensation for damages,consulting experts and scholars,and exploring practi-cal issues through visiting case handling departments,so as to solve the difficult issues encountered in handling forestry ecological environment compensation cases,and provide theoretical and technical support for the practice.
