The Improvement of Criminal Law Regulation of Vicious Organization——From the Perspective of Convergence with the Anti-Organized Crime Law
With the promulgation of the Anti-Organized Crime Law,China's vicious organization has un-dergone a transformation from non-legal terms to formal legal concepts.To re-examine the law and the provisions of China's criminal law on vicious organizations,it can be found that there are some loopholes in the criminal law's regulation of vicious organizations.Therefore,it is suggested that future legislation be revised to"add the crime of leading,organizing,and participating in vicious organization","clarify the primary leader of vicious organization"and"adopt a high degree of conclusive proof standards and apply the principle of criminal presumption",so as to establish and improve a long-term mechanism for combat-ing,preventing,and governing vicious organization.
