摘要
非法集资案件中,涉案财产的追缴与处置是集资参与人最为关心的问题.妥善规范追缴与处置非法集资涉案财产,不仅涉及法益修复,而且有助社会矛盾化解.但司法办案实践中该类案件涉案财产的追缴与处置仍存在诸多问题亟待解决,对此,检察机关应积极转变理念,充分发挥检察监督职能作用,立足经济视角,探索建立在检察机关监督下,司法、行政等相关部门及第三方机构共同落实推进的非法集资案件涉案财产追缴与处置以及保值增值机制,为最大程度的为投资人挽回损失、维护社会稳定、推进国家治理体系和治理能力现代化贡献力量.
Abstract
In the cases of illegal fund-raising,the recovery and disposal of the property involved is the most concerned issue of the fund-raising participants.Properly standardizing the recovery and disposal of the property involved in illegal fund-raising will not only involve the restoration of legal interests,but al-so help resolve social conflicts.But the judicial case practice involved the property recovered and dispos-al still exist many problems to be solved.To this,the procuratorial organs should actively change ideas,give full play to the functions of procuratorial supervision,based on economic perspective,explore to estab-lish the supervision of the procuratorial organs,the judicial and administrative departments and third party together to promote the illegal fund-raising cases involved property recovered disposal.Therfore,to the maximum limit,we can recover investors'losses,maintain social stability,and promote the modernization of national management system and management ability.
