侵害未成年人案件学校强制报告制度的反思与重构

摘要
考察分析侵害未成年人案件强制报告典型案例,发现学校强制报告制度存在义务主体范围不明、受理部门不清、责任机制难以适用的问题.制度的完善首先要明确义务主体囊括所有工作人员且责任需落实到个人,可通过线索归口管理制度强化学校强制报告制度的可操作性.应建立专门的未成年人保护机构,以实现案件的统一受理和对未成年被害人的综合性保护.责任机制方面应取消"造成严重后果"的条件,细化行政责任、审慎追究刑事责任、引入民事责任.
Abstract
By investigating and analyzing the typical cases of compulsory reporting of cases of infringe-ment on minors,it is found that the school compulsory reporting system has problems such as the scope of unclear obligations,the unclear acceptance department,and the difficulty of applying the responsibility mechanism.To improve the system,it should first be clear that the subject of obligation includes all the staff and the responsibility should be implemented to the individual.The operability of the school compul-sory reporting system can be strengthened through the centralized management system of clues.A special agency for protecting minors should be established to realize the unified acceptance of cases and the com-prehensive protection of minor victims.In terms of responsibility mechanism,the condition of"causing seri-ous consequences"should be cancelled,administrative responsibility should be refined,criminal responsibil-ity should be investigated prudently,and civil liability should be introduced.
