On the Boundaries and Control of Procuratorial Authority in Case-Related Corporate Compliance
As the initiator of local enterprises compliance institutional improvement,the leader of institu-tional innovation,the builder of institutional frameworks,and the supervisor of institutional construction,the procuratorial authorities have taken a leading role in the review of corporate compliance in China.However,in the development of practice,due to the unclear top-level legislation and disorderly expansion of procuratorial power,there is a tendency for the procuratorial power to intervene in the power of investi-gation,the investigative power of administrative organs,and the trial power of courts.Meanwhile,there is also a lack of"judicial review"regulation of court.Therefore,it should focus on the positioning of procu-ratorial functions,explore new functions for compliance based on traditional procuratorial functions,and re-alize the clear boundaries and power control of procuratorial power from the two-tiered path between the internal and external dimensions.
