Ways to Control Illegal Occupation of Agricultural Land
Through the analysis of the cases handled in recent years,it is found that the handling of the crime of illegal occupation of agricultural land presents the characteristics of high non-arrest rate,high non-prosecution rate and high probation rate.This judicial situation is based on theory and reality.Howev-er,through this situation,we can find that the administrative law enforcement is not enough,the judicial discretion standards are not unified,the relevant legal provisions and other deep-seated problems.It is the appropriate path to strengthen the protection of agricultural land in China to refine the relevant provisions of the criminal law,to establish the "double punishment system" of administrative punishment,to unify the judicial discretion standards,and to pay more attention to comprehensive management.
