Reflection and Improvement of Procuratorial Supervision over Compulsory Isolation and Drug Rehabilitation
In judicial practice,mandatory isolation for drug rehabilitation is decided by the public security organs and handed over to drug rehabilitation centers for execution,which has been in operation for many years.In order to avoid non-standard issues,in recent years,the Supreme People's Procuratorate and the Ministry of Justice have gradually implemented a mandatory quarantine and drug rehabilitation procuratori-al supervision system throughout the country.From the judicial practice of C municipality,it can be seen that the operation of the compulsory isolation and drug rehabilitation procuratorial supervision system is gradually deepening.However,there are also problems such as lack of legal provisions,incomplete supervi-sion rules,unclear responsibilities,unclear supervision positioning,unclear supervision subjects,lagging work,insufficient supervision cooperation,and insufficient allocation of procuratorial power that urgently need to be solved.To further standardize the operation of the compulsory isolation and drug rehabilitation system and implement the protection of the personal rights of drug rehabilitation personnel,it is necessary to start from multiple aspects such as supervision rules,supervision positioning,supervision subjects,and supervi-sion capabilities,and improve the construction of the system of compulsory isolation and drug rehabilitation procuratorial supervision.
