Practical Observation and Institutional Improvement of Supervision over Civil Prosecutorial Cases under the Implementation of the Civil Code
Under the normative guidance of the Civil Code,the supervision of civil procuratorial cases is no longer a mere formality.By examining the judicial practice,it is found that the supervision of civil procuratorial cases presents the characteristics of development,such as the continuous deepening of precise supervision,the continuous expansion of the scope of supervision,and the continuous extension of the effec-tiveness of social governance.However,under the background of the implementation of the Civil Code,there are still problems such as the lack of systematic supervision legal norms,the supervision ability of similar cases to be improved,the supervision mechanism of similar cases to be improved,and the rigidity of clue collection and supervision to be strengthened.It is necessary to take the implementation of the Civil Code as an opportunity to improve the effectiveness of supervision from the aspects of optimizing the legal standard system,improving the discovery mechanism of such cases,improving the supervision mode of such cases,and improving the supervision ability at the grass-roots level.
