On the Substantive Legality Criterion for Conducting the Review of Normative Documents
The review standard is the criterion for conducting the review of normative documents for the record. Legitimacy review standards are an important part of the standards for the review of normative doc-uments for the record,but at present,there are different understandings of legitimacy review standards in the academic and practical communities,and the legitimacy review standards are mainly limited to the re-view of formal legitimacy. Following the requirements of the rule of law thinking and the rule of law ap-proach,it should be combined with the current status quo of the application of the filing review of nor-mative documents to take substantive legality as the benchmark for the review,realizing the transforma-tion from the rule of law in form to the rule of law in substance,and improving the operability of the re-view of legality,so as to realize the supervisory function.
