Interpretation of the Rules of Advance Registration Against Mandatory Enforcement
As the basis for excluding mandatory enforcement by the right holder of advance registration,Article 30 of Provisions on Reconsideration of Execution of Objections has ambiguity in its specific appli-cation. In practice,the registration department will not actively cancel it and advance registration still ex-ists even if the period of 90 days for advance registration has passed. At this time,various opinions on whether the provisions of Article 30 can be applied to exclude mandatory enforcement appear. Based on the combing of the purpose of the advance registration system and the background of the release of the Provisions on Reconsideration of Execution of Objections,coupled with the inclusion of the protection of consumer rights and interests as one of its value orientations by Chinese law,protection should also be moderately tilted towards real estate consumers in the domain of civil mandatory enforcement.
