Empirical Research on the Procuratorial Supervision in the Substantive Review of Commutation and Parole Cases
To improve the quality and effectiveness of procuratorial supervision in commutation and parole cases,the"three elements"should be used as the overall leadership,and it should adhere to the whole-process and embedded supervision of the submission of criminal penalty enforcement organs and the trial and ruling activities of judicial organs,to eliminate the disadvantages of"formal"review.Through the re-view and verification of evidence materials,combined with the nature,the degree of social harm,and the performance of property judgments of the original case,the handling of the case is standardized in terms of entities and procedures,so as to improve the quality and efficiency of supervision,and ensure the fairness and justice of the execution and change of penalties.
