摘要
植物新品种权是我国知识产权的重要组成部分,我国从法律层面保护植物新品种权人的权益,鼓励育种者在新品种培育、推广上的投入和研发.本文介绍了近年来安徽省林木植物新品种的授权情况和保护现状,分析了新品种保护中存在的品种权保护水平偏低、保护执法力量不足、成果转化效率不高等问题,并从加强培训宣传、加强行政保护、加强科研攻关和推广示范等方面提出新品种保护对策.
Abstract
The rights of new plant cultivars are important parts of China′s intellectual property rights,and the owners′rights and inter-ests are protected from the legal level in China encouraging investment,research and development in cultivation and promotion of new cultivars.In this paper,an introduction was made to the actualities of new forest plant cultivar authorization and protection in Anhui Province in recent years with an analysis on the existing problems in the process including low level of protection,insufficient enforce-ment force and low commercial use of achievements.Targeted suggestions for protecting new cultivars were put forward including strengthening training and publicity,administrative protection,scientific research and demonstrative promotion.
