German Practice of Uploader Rights Protection in Copyright Filtering and Future Reference
The Act on Copyright Liability of Online Content Sharing Service Providers formulated to transform Article 17 of the EU's Digital Single Market Copyright Directive has formally entered into force on August 1,2021.While transforming the directives,the law also designs procedural rules for the protection of uploader rights and interests in copyright filtering from both content uploading and dispute resolution.On the one hand,the presumed permission use rules allow users to upload content temporarily without being blocked or deleted when certain conditions are met,specifically including minor uses and flagging of uses;on the other hand,The dissenting copyright owners can obtain the final decision through the follow-up dispute resolution mechanism.These dispute resolution mechanisms include complaint mechanisms,out-of-court dispute resolution mechanisms and judicial relief mechanisms.These rules in the Act will be of great value for future reference when our country introduces rules to regulate the network service providers'copyright filtering technology.
