The Rule of the Centennial Changes of the Chinese-style Rural Land System and Its Enlightenment
As the basic system of national governance which has gone through the whole process of Chinese-style modernization,China's contemporary rural land system is of profound historical significance for promoting Chinese-style modernization,with the rule of its centennial changes.The analyses by means of the systematic methodology of developmental legal science,demonstrate that these centennial changes have presented two types of rural land system with various operating mechanisms.While one type of system is based on the exclusion of interests,the other is based on the inclusion of interests.The centennial changes in the rural land system have been deeply rooted in the relations between the state and its citizens,between the central and local governments,and between China and other countries in different periods,forming triple driving forces that have promoted the changes of the rural land system.The above rule shows that institutional modernization is the core of Chinese-style modernization,and that the people's democratic rights are the foundations of institutional modernization,which determine the future process of Chinese-style modernization.This rule not only demonstrates the explanatory power and guiding force of developmental legal science,but also provides solutions to the global difficult problems in the study of law and development with the help of Chinese examples.
