数据治理时代行政程序的理性偏航与技术性补强

摘要
在数据治理时代,行政程序作为"权力—权利"制衡结构的核心设计愈发重要.立足于行政程序的价值理性,数据治理被赋予助力风险行政程序、促进给付行政程序以及优化秩序行政程序的功能期待.但实践表明,数据治理成为侵蚀制衡机构的存在,行政相对人对等地位降格、程序性权利被吞噬,而行政主体也获得了技术性外衣的庇护,行政程序工具理性复归.究其原因,算法数据的引入由行政主体掌控,且其运用场域为行政权力运行过程,本应存在的外在约束力量缺位.对此,应当重申程序本位主义的正当价值,在此基础上调整规则合法性以及功能有效性之间的紧张关系,从算法、立法和司法三个维度技术性补强原有制衡结构.
Abstract
In the era of data governance,administrative procedures are becoming more and more important as the core design of the "power-right" checks and balances. Based on the value rationality of administrative procedures,data governance is endowed with the functional expectation of assisting risk administrative procedures,promoting payment administrative procedures,and optimizing order administrative procedures. However,practice shows that data governance has become the existence of erosion checks and balances,the administrative counterpart' s equal status has been degraded,procedural rights have been swallowed up,and the administrative subjects have also been sheltered by the technical coat,and the instrument rationality of administrative procedures has been restored. The reason is that the introduction of algorithmic data is controlled by the administrative subject,and its application field is the operation process of administrative power,and the external constraint force that should exist is absent. In this regard,we should reiterate the procedural departmentalism,draw lessons from the theory of technical due process,and strengthen the original balance structure through the three dimensions of algorithm,legislation and judicature.
