摘要
网络暴力是对数字弱者实施反复、持续的恶意伤害的行为,其在不同的目的动机、行为方式、暴力程度下具有各自不同的表现形态.从其流变史来看,网络暴力经历了从静态、单向输出到瞬时、交互对抗,再到去中心化、自主肆意释放的过程,网络暴力的样态转变与数字化的加速内推紧密相关.当前,网络暴力的持续性与严重危害性、频发态势与群体极化效应、复杂成因与动态发展变化给受害个体的安宁、网络文明建设、现行治理模式带来了巨大挑战.为进一步完善网络暴力的整体治理,需要兼顾引导与规制,并从网民素养、平台责任、法律规范、数字痕迹四个方面,按照一体双向四面的结构依次开展.
Abstract
Cyber violence is a repeated,continuous and malicious act against the digitally vulnerable,which has different manifestations under different motivations,modes of behavior,and degrees of violence. From its evolutionary history,cyber violence has gone through a process from static,unidirectional output to transient,interactive confrontation to decentralized,autonomous release. The paradigm shift of cyber violence is closely related to the accelerated inward thrust of digitization. At present,the persistence and serious harm,frequent occurrence,and group polarization effects of cyber violence,as well as its complex causes and dynamic development,pose significant challenges to the peace of victims,the construction of online civilization and the current governance model. In order to further improve the overall governance of cyber violence,it is necessary to balance guidance and regulation,and implement it in a structure of one body,two directions,and four sides from four aspects:netizen literacy,platform responsibility,legal norms,and digital traces.
