Differing from the concept of rights in the existing theoretical paradigms of classical natural law the-ory,of analytical legal positivism,and of utopian socialist jurisprudence,Marxist jurisprudence view of rights,under the thinking frame of historical materialism,treats rights in a grand and broad vision of historical chang-es,treats rights in a dynamic and changing way,and treats rights in the context of a theoretical analysis of polit-ical economy.Such rights,recognized in the retrospection of history,in the consideration of the reality,and in the prediction of the future,play a leading and indicative role in the development of human society and the self-reform of law.A deep understanding of Marxist jurisprudence view of rights is of great guiding significance for constructing socialist legal theory with Chinese characteristics and exploring the proper connotation of the concept of rights in China jurisprudence.
