The Organizational Logic of Accredited Supervision:Legal Status,Duties,and Boundaries—Thinking on Constructing a Discipline System of the Study of Discipline Inspection and Su-pervision with Chinese Characteristics
To be accredited is an important form of China's national organization whose essence is self-super-vision,which realizes the separation of the unified personality of organization subject and the specific supervi-sion function,and is an important manifestation of the strategic thought of self-revolution.On the basis of the Constitution,the Supervision Law,the Organic Law of State Organs,and relevant regulations and norms,this ar-ticle systematically analyzes three theoretical issues(i.e.the legal status and structure of an accredited agency,the supervision duties of accredited supervision,and the role and behavioral boundaries of accredited supervi-sion)by using the organization theory at the national level of constitutional jurisprudence,in order to try to con-struct a discipline system of the study of discipline inspection and supervision with Chinese characteristics.The analysis shows that an accredited agency is a kind of state organ with partial legal capacity,and that it forms a representative relationship with the discipline inspection and supervision organ that accredits it.As an organiza-tion for accredited supervision,an accredited agency in its operation should reasonably clarify the four legal du-ties of an accredited agency on the basis of the principle of democratic centralism and the principle of socialist rule of law,and establish the activity order of the dynamic classification of accredited supervision.
