An Exploration of Legislative and Judicial Experience in Ancient China:A Discussion on the Confucianization of Ancient Chinese Laws
Ancient Chinese society had thousands of years of legislative and judicial experience."The unity of rites and punishments","rites as the principal and punishments as the secondary", and a combination of stable and flexible legal forms, effectively resolved contradictions between law and morality, law and society, and law and the trend of the times. The legal system with a Confucian foundation is not only compatible with Legalist thought but also bridges history and reality, which enabled the effective utilization of the experience in the rule of rites from Xia, Shang, to the Western Zhou and the experience of in the rule of law from the Spring and Au-tumn period to Qin, made dominant legal ideologies established by dynasties consistent with the mainstream val-ues widely recognized in society, and thus effectively ensured long-term stability of society.
