法规范论视角下党的领导法规探析

运用法规范理论分析,党的全面领导与党中央集中统一领导共同构成了党的领导行为的整体.在党的全面领导视域下,党的领导法规是党的意志的最高表达形式,具有完整的规范逻辑结构,其完善发展也必然遵循这样的逻辑.在党的全面领导关系链中,党的领导法规主要规范和保障作为党组织的领导行为,而不是作为非党组织的被领导者的行为,其要解决的是领导者应如何实施领导的问题,起着科学配置党的领导权的作用.
An Analysis of the Party's Leadership Regulations from the Perspective of the Law Norm Theory
According to the law norm theory,the overall leadership of the Party and the centralized and unified leadership of the Party central committee jointly constitute the leadership behavior of the Party as a whole . It is found from the study by introducing the law norm theory in the view of the overall leadership of the Party,the Party's leadership regulations are the highest expression of the Party's will,which is structured in a complete normative logical way,and its perfect development is bound to follow such a logical way. In the relation chain of the overall leadership of the Party,the Party's leadership regulations mainly regulate and guarantee the leader-ship behavior of the Party organizations,rather than the behavior of the non-Party organizations being led,which is to solve the problem of how a leader should lead and to play a role in scientifically allocating the Party's lead-ership power.
