美国航空客运反垄断执法政策转变及其启示——兼评美国"东北联盟"航空联营案

摘要
2020年,美国航空与捷蓝航空签署联营协议拟建立"东北联盟",在通过反垄断"预先审查"之后,却被美国司法部起诉由美国法院判决禁止联营.这是自1978年开始对航空公司放松管制以来,美国法院首次禁止航空联营,且拒绝接受任何补救措施条件.美国航空客运反垄断执法政策转向将会直接给各国航空承运人参与国际竞争带来重要影响,如果延续航空公司放松管制时代的反垄断政策和竞争分析思路,我国航空公司不仅可能在国际市场频遭碰壁,还会因为国内政策掣肘逐渐削弱原有的竞争优势.
Abstract
In 2020,American Airlines and JetBlue Airways signed a joint venture agreement to estab-lish the"Northeast Alliance".However,after passing the anti-monopoly"pre-review"system,they were sued and ordered by US court to prohibit the joint venture.This is the first time since the relaxation of regulations on airlines in 1978 that US court has banned aviation alliances and refused to accept any con-ditions for remedial measures.The shift in anti-monopoly enforcement policies for US air passenger transport will directly have a significant impact on the participation of air carriers from various countries in international competition.If the anti-monopoly policies and competitive analysis approach of the era of airline deregulation continue,Chinese airlines may not only face frequent setbacks in the international market,but also gradually weaken their existing competitive advantages due to domestic policy con-straints.
