On the Legal Balance Between Animal Epidemic Prevention and Animal Rights
The interaction between animal and human has a long history.Animals not only provide nourish-ment and services for humans,but also carry viruses that pose a threat to them.There is a dialectical relation-ship between protecting animal rights and preventing animal infectious diseases.In traditional law,animals are the objects of legal system and occupy a subordinate position in the relationship between human and animal.Animals are object to be controlled,traded and compensated in property law,contract law and tort law.How-ever,animals have special characteristics and are"things"with"vitality".After the concept of public health emerged,animal epidemic prevention law became an important aspect of modern law.There are a series of le-gal systems such as the Animal Epidemic Prevention Law,the Wildlife Protection Law and the Regulations on the Management of Experimental Animals in China.The relationship between human and animal has shifted from anthropocentrism to ecocentrism,and protecting animals means protecting ourselves.The animal rights theory has emerged.The Animal Epidemic Prevention Law,the Animal Welfare Lawand the Animal Protection Law are all aimed at reconciling the contradictions between animal epidemic prevention and animal rights,and achieving a balance of interests between human and animal.
