Realistic Dilemma and Path Optimization of Personal Information Protection of Minors
In the era of big data,the protection of personal information is of increasing concern.As a special subject,the protection of minors'personal information and privacy has important practical value.Although China has already constructed preliminary legislative rules,there are still some practical dilemmas,such as unclear definition of the age division of sensitive information of minors,insufficient rules of guardian's consent,and localization of minors'right to be forgotten.Considering the latest legislation of overseas countries and relevant judicial practice in China,based on the adherence to the principle of favoring minors,it is necessary to make a three-phase demarcation of the age standard of minors,to propose the future way out of consent rule of the guardian,and to improve the system of protection of the right of minors to be forgotten,so as to optimize the legal protection of the personal information of minors in China.
