论有力法治如何助力有为政府与有效市场更好发挥作用

摘要
高水平社会主义市场经济必定是有效市场与有为政府共同发挥作用的经济,而市场有效与政府有为需要依靠有力法治的保障,这是本文的主题.为此,本文从三个方面展开分析.首先,法律法规既是改革成果与成熟经验的及时总结,也是进一步发展经济和政府治理的指导,全社会必须秉持法治意识,遵循法治思维.其次,法治可以界定政府与市场的边界,助力政府依法行政,纠正市场失灵,服务市场经济,提升治理能力.最后,法治是市场经济的灵魂.法无禁止皆可为,可以最大限度地激发市场的活力和创新力,厚植高质量发展的经济基础.总之,只有法治有力,才能做到政府有为和市场有效,共同助力高水平社会主义市场经济体制建设.
Abstract
A high-standard socialist market economy must be an economy in which an efficient market and an effective government play a role together,and the efficient market and the effective government both need a strong rule of law to sustain.This is the subject of this paper and is examined from three aspects.First,laws and regulations are not only a timely summary of the achievements of reform and mature experience,but also a guide for further economic development and state governance.Second,the rule of law can define the boundary between the government and the market,help the government administer according to law,correct market failures,serve the market economy,and improve governance capabilities.Third,the rule of law is the soul of a market economy.By adhering to the principle that"everything which is not forbidden is allowed"we can stimulate the vitality and innovation of the market to the greatest extent,and lay a solid economic foundation for high-quality development.In short,only under a strong rule of law can the government be effective and the market be efficient,and the two work together to create a high-standard socialist market economy.
