土地储备环节污染场地治理与修复责任——以常州"毒地"事件为例

摘要
常州"毒地"事件使得污染场地治理与修复责任问题引发社会广泛关注,其中政府土地储备行为的界定是常州毒地案一个重要的争议焦点.通过分析常州毒地案中的土地储备行为,可以把土地储备制度的运作过程分为3个具体阶段,各个阶段存在相对应的污染场地治理与修复责任主体.污染场地治理与修复的责任主体确定以后,还需要确定依法追究各责任主体责任所遵循的原则.结合我国国情,在土地储备环节,我国应确立无过错和过错责任相结合原则、污染责任终身制原则、非连带责任原则以及污染者适用溯及既往责任原则.
Abstract
The event of "poisonous land"of Changzhou has aroused widespread social concern over the governance and restoration of polluted land, among which the definition of the land banking of the government is an important focus of dispute. Trough analysis of the land banking of the government in the case of "poisonous land"of Changzhou, the operation procedure of the land banking system can be divided into three specific stages and there is corresponding governance and restoration subject responsible for the polluted land in each stage. When the subject who is responsible for the governance and restoration of the polluted land is determined, the principles in which the accountability of the each responsible subject is defined in accordance with law should also be confirmed. Based on current national conditions, China implements the principle of nofault liability combining with fault liability, the principle of lifelong responsibility for the pollution, the principle of non-joint liability and the stipulation that the polluters are applicable to the retroactive liabilities in the land banking work of our country.
