法律监督权的刚性提升症结与再行路径——职务犯罪侦查权移转监察委后的监督方略

摘要
纵观权力制度体系历史,监督权属于权力制度体系中的重要内容但并非核心或唯一内容.检察机关作为宪法规定的法律监督机关,无论在制度设计层面还是实践创新层面,一直在努力多举措提升监督刚性.但这些举措未能取得明显成效,其症结在于监督权力的权力束不足、内敛式的自我评价限制了监督权的独立行使、收益与成本分析下的监督者行权激励不足、现实主义视角下监督权行使存在柔性选择等方面.在职务犯罪侦查权作为法律监督权强力后盾已失的情况下,未来提升法律监督权刚性应当增加监督权力束、设定外放式的综合评价指标提升监督刚性,还要利用更广泛的民主,借用监察委的权力刚性来综合提升自身的法律监督权力刚性.
Abstract
The power of supervision is an essencial but not only content of power system. How to promote supervision rigidity within the power system is a common issue to be addressed in both history and reality. As a legal supervision organ, procuratorial organs have been trying to improve their supervisory rigidity in many ways.The crux for promoting supervisory power's rigidity is that the power bundle of supervision power is insufficient, the introverted self evaluation restricts the independent exercise of supervision power, the inadequacy of supervisors' power incentive under the analysis of income and cost, and the flexible exercise of power under the perspective of realism. The future promotion of the rigidity of the right of legal supervision should increase the power of supervision, set the comprehensive evaluation index of the external type, use the broader democratic supervision force, and borrow the power rigidity of the supervisory committee to comprehensively enhance its rigidity.
