从国际私法的视角审视张爱玲版权归属问题

摘要
利用国际私法的法律工具，依次从识别、冲突规范、先决问题，到外国人遗嘱的效力、解释、执行以及外国法的查明与适用的逻辑顺序，循序渐进地探讨了张爱玲作品的版权归属问题，并因此得出应依张爱玲死亡时住所地法决定其作品版权归属的结论。最后就我国应完善相关立法以及加强知识产权国际保护以更好地处理涉外版权争议提出了自己的见解。
Abstract
The copyright problem of Eileen Chang’s literary works is discussed in this paper.It is concluded that it should be deter-mined according to the laws of the place where Eileen Chang died.Then,some opinions are proposed on perfecting relevant legislation in China and strengthening international protection of intellectual property rights.
