摘要
近年来,随着跨区域建设指标平衡及交易、容积率奖励及转移等地方试点的出现,以及国土空间规划体系的建立、"集体经营性建设用地入市"的提出,围绕土地开发权的讨论不断增加.中国语境下的土地开发权与其土地二元公有制背景、土地供应市场息息相关,在土地管理与规划管理领域的立法过程中不断显现和明晰.文章首先溯源土地开发权的制度起源,理解其背后的形成逻辑,辨析相关概念;然后通过梳理我国建国以来土地制度法治化过程,厘清土地开发权的法理基础和制度演变,以总结其运行规则;进而分析我国土地开发权的形成逻辑,明确其中公权与私权的内在关联性,最后对我国空间规划权的行使提出建议.
Abstract
In recent years,with the emergence of local pilot projects such as balance and trading of cross regional construction indicators,rewards and transfer of plot ratio,as well as the establishment of the national spatial planning system and the proposal of"collective operating construction land entering the market",discussions around land development rights have continued to increase.The land development rights in the Chinese context are closely related to the background of dual public ownership of land and the land supply market,and are constantly emerging and clarified in the legislative process of land management and planning management.This article first traces the institutional origin of land development rights,understands the formation logic behind it,and analyzes related concepts.Then,by sorting out the process of legalizing the land system in China since the founding of the People's Republic of China,clarifying the legal basis and institutional evolution of land development rights,in order to summarize their operating rules;Further analyze the formation logic of land development rights in China,clarify the inherent correlation between public and private rights,and finally provide suggestions for the exercise of spatial planning rights in China.
