摘要

集体建设用地的集约化重构是盘活存量,促进城市高质量发展的主要途径,其核心是对土地权益的配置与调节:自上而下的规划管控中形成了土地权益的非均衡配置,制约着规划实施,公平正义的权益调节机制成为空间集约化重构的关键.研究构建了集体建设用地集约化重构中权益格局形成、演变与调节的理论框架,以佛山市南海区为案例,揭示了以下发现:在模糊的土地产权制度下,市场驱动的村庄自主土地开发形成了集体建设用地初始权益配置的差别.以集约、节约为导向的规划管控不可避免地强化了这一差别,造成市场与规划的双重公平偏离.非均衡的权益配置制约着空间的集约化重构,有赖于公平的权益调节机制加以化解:地方政府充分发挥权益调节职能,在重构过程中逐步建立了三种不同的权益调节模式,并呈现出统筹尺度上移、分配标准明晰、调节力度增强的演变特征.集体建设用地的集约化重构当在利益平衡的思路上,有针对性地建立适应不同发展特征的动态权益调节机制,兼顾效率和公平.

Abstract

The intensive reconstruction of collective construction land serves as a paramount strategy for rejuvenating existing assets and catalyzing superior urban development.At its essence,this process pivots on the reconfiguration and adjustment of land development rights.While top-down planning often culminates in unbalanced land development rights distribution and constrains planning implementation,a land rights adjustment framework anchored in principles of equity and justice emerges as indispensable for the intensive spatial reconstruction.This article constructs a theoretical framework for the formation,evolution,and adjustment of the rights pattern in the process of intensive reconstruction of collective construction land.Taking Nanhai District of Foshan City as a case study,the following findings are revealed:Under the ambiguous property rights system,the market-driven independent development of villages has precipitated disparities in the initial allocation of collective construction land rights.The combination of intensive and frugal planning controls inevitably magnifies these disparities,leading to dual deviations from equity influenced by both market forces and spatial planning.The unbalanced allocation of rights constrains the intensive reconstruction of space,necessitating an equitable mechanism for rights adjustment.In response,local governments have harnessed their redistributive capacities,progressively instituting three distinct land rights adjustment paradigms throughout the reconstruction phases,which manifest dynamic characteristics of an overall scale shift,clear distribution standards,and enhanced adjustment intensity.In line with the perspective of balancing interests,the intensive reconstruction of collectively developed land should strategically establish a targeted dynamic rights adjustment mechanism.This mechanism should be designed to accommodate different developmental features while maintaining a balance between efficiency and equity.
