摘要

集体经营性建设用地入市是实现集体土地还权赋能、促进城乡融合发展的重要途径.然而,北京的入市试点项目在国土空间用途管制实施过程中遭遇多重挑战.构建"控制权界定土地发展权"的分析框架,依据国土空间用途管制的"规划—建设—治理"链条,将地方政府对土地开发的控制权分解为规划编制权、实施许可权、治理监督权等三大维度,明晰其运作的影响因素,由此解释入市实施挑战及其形成机制.研究发现,尽管集体土地入市促进了集体土地名义发展权的强权赋能,但地方政府的控制权行使造成集体土地实际发展权的三次弱化.此权利弱化蕴藏于发展理念转型下地方政府的多元目标兼顾困局,形成于建设指标约束下的地方财政优先导向,加深于资源反哺农村下的政府监督渗透强化.提出面向城乡融合的国土空间用途管制实施路径与配套政策优化建议.

Abstract

The commodification of collective construction land is an important strat-egy to empower rural collectives and promote urban-rural integration.However,the pilot project in Beijing has encountered multiple challenges during the implementa-tion of territorial space use regulations.Following the chain of planning,construc-tion,and governance for regulating territorial spaces,this paper breaks down the lo-cal government power over land development into three components:planning,devel-opment permits,and planning governance and supervision.It then identifies factors that influence power operations,shedding light on the challenges and mechanisms of collective construction land commodification.The study reveals that although the en-try of collective land into the market has reinforced the de jure development rights of collective land,the exercise of local government control power has weakened the de facto rights on three occasions.This weakening is attributable to local govern-ments'ambition to achieve multiple goals simultaneously while the conceptual under-standing of development is undergoing transformation.Under the constraints imposed by construction land quotas,local public finance concerns often take precedence,and this situation is exacerbated by the penetration of government power into investment resource allocation in rural areas.Finally,the paper provides proposals to improve regulatory implementation to promote urban-rural integration.
