摘要
中国村镇建设在发展中由于对地方特色的关注和理解不够,再加上国内相关风貌管控法规文件体系建设本身存在不足,致使一些地区的村镇规划与建设中缺乏必要的风貌管控内容.整理了全国层面以及以上海为代表的地方层面既有的村镇规划相关法规文件,基于文件对象、法律效力、管控要素对其进行梳理与归纳,研究我国村镇规划相关法规文件中风貌管控内容.同时,依据村镇规划法规文件的现状和国家关于村镇建设的新要求,评估分析既有体系在组织架构、管控内容和管理实施方面存在的问题,提出相应的优化建议.
Abstract
Insufficient attention to local characteristics in the development of China's villages and towns,coupled with deficiencies in laws and regulations for built-environment style and feature control,has resulted in a lack of necessary plan-ning control on local characters in certain areas.This paper compiles relevant na-tional and local laws and regulations on village and town planning,with Shanghai has a representative case.Based on the regulatory content,legal effectiveness,and control elements,it summarizes the regulations and legal documents,focusing on style control in village and town planning in China.Moreover,taking into consider-ation the current status of village and town planning laws and regulations and new national requirements on village and town development,the paper assesses the exist-ing regulatory system in terms of organizational structure,control content,and man-agement implementation.Finally,it proposes optimization suggestions to address the problems encountered in the system building process.
