The Legal System of State Ownership of Natural Resources:Past,Present and Future
The state ownership of natural resources is the power of the state to control and protect the important natural resources related to the interests of the whole people according to the will of the whole people.Its value goal,exercise subject,object scope and system content will develop with the development of society,and the relevant legal system should also be reformed accordingly.Before the 18th National Congress of the Communist Party of China,the legal system of state ownership of natural resources in China,with the efficient use of specific economic resources as the core,has undergone a transformation from a planned system to a market economy.Since the 18th National Congress of the Communist Party of China,the ecological value of natural resources has been highlighted,the legal system for the exercise of national ownership has moved forward toward ecology and green,and the institutional system has been further expanded and improved,but there is still a gap with the requirements of ecological civilization construction.In the future,the legal system for the exercise of state ownership of natural resources should move towards the integrated management of the ecosystem with the aim of maximizing the public good,make major changes in the concept,goal,system construction and concept use,strengthen basic legislation and improve the legislative system.
