摘要
近代中国形成"富强为体,宪制为用"范式的文化起点是刻画在中国传统中的实用主义.急功近利的实用主义是中国宪制文化展现出的基本品格.近代先进的中国人在谋求建立宪制的过程中,假定了"宪制为因,富强为果"的逻辑关系,这种假定的背后存在自由主义和集体主义的思维分歧.宪制与富强之间既存在内在价值上的冲突,也可以在国家面临内忧外患的情形下融汇.在没有宪制文化积淀的情况下,对宪制进行"截取"般的利用是难以成功的,故培育宪制文化成为历史留给当前宪制建设的重要启示.其中,对富强含义进行新的解读尤为必要.
Abstract
In modern China,the cultural starting point of the"prosperity as the body,constitutional system as the application"paradigm is pragmatism in Chinese tradition.The pragmatism of seeking quick success and instant benefits is a fundamental character exhibited in the Chinese constitutional cul-ture.In modern times,advanced Chinese people,in their pursuit of establishing a constitutional system,assumed a logical relationship of"constitutional system as the cause and prosperity as the result".Be-hind this assumption lies a divergence of thinking between liberalism and collectivism.There is an inher-ent value conflict between constitutionalism and prosperity,but it can also be integrated in situations where the country is facing internal and external troubles.Without the accumulation of constitutional cul-ture,rough utilization of constitutional system is difficult to succeed,so cultivating constitutional culture has become an important inspiration left by history to the current constitutional construction.It is particu-larly necessary to provide a new interpretation of the meaning of prosperity.
