摘要
随着新修订《档案法》的颁布实施,档案主管部门、档案馆、档案形成单位或移交单位被赋予新的权力与职能,形成新的权力结构模式.基于权力理论与行政管理学视角,研究档案开放中权力的分配逻辑,剖析目前权力分配制度存在的主要问题,提出构建档案开放权力运行程序、监督机制、权责对等规则及完善权利救济途径等策略,有利于推进档案开放权力配置走上合理化、法治化发展轨道.
Abstract
As the newly revised Archives Law is enacted and implemented,new powers and functions are assigned to archival authorities,archives,institutions that create or transfer archives in the process of opening of archives,and a new power structure pattern has been established.From the perspective of power theories and administration science,this study researches the logic of power allocation in the opening of archives,analyzes the main problems of the current power allocation system,and explore the strategies of developing the power operation process related to the opening of archives,supervision mechanisms,power-responsibility rules,as well as improving the ways of right remedy,which is conducive to promoting the allocation of the power in archives opening to embark on the track of rationalization and development under the rule of law.
