Research on the Judgment Basis and Time Limit of Delayed Opening of Archives
This paper focuses on the criteria and time limit for judging the delayed opening of archives.It sorts out the criteria for determining the delayed opening of archives in current regulatory documents and divides them into six categories:(1)those that still belong to state secrets;(2)information related to national security and social stability that may bring potential risk;(3)involving intellectual property rights;(4)involving personal information;(5)the archive donor requests delayed opening or closure;(6)other situations that delayed opening are required in accordance with relevant laws,administrative regulations,and national regulations,which are discussed in detail,with a focus on the issue of extension time limits for situations in categories(2),(3),and(4).At the end of the paper,it is pointed out that in order to avoid the permanent exemption of opening,a system arrangement of regular rolling retrial should be established after the expiration of the regular closure period.
