How to Examine the Registration of Works Involving Artificial Intelligence Creation——Based on U.S. Copyright Registration Practices and Implications
Generative Artificial Intelligence (AI) is being widely used in massive content generation, which has already subverted the traditional creation mode. The AI outputs with the appearance of works have brought enormous review pressure to copyright registration organizations. In the face of large- scale applications for work registration of AI outputs, how to judge the suitability of the registered object, examine the authenticity of the signature, and identify the "black box" problem of creation have become a major challenge for copyright registration organizations. Internationally, the U.S. copyright registration system, which is constructed on the basis of anthropocentrism, reaffirms the subjective status of human authors in the review of copyright registration, unifies the"binary review standard"for AI-related outputs, and emphasizes the disclosure obligation of applicants. It also emphasizes the applicant's disclosure and marking obligations, which provides a new way of thinking for dealing with AI outputs. China's copyright registration authorities should focus on the real problems in the practice of work registration, give full play to the function of public service, and actively explore the registration mechanism to deal with AI-related creative works, so as to improve the copyright protection rules for artificial intelligence outputs.
