Deepening the legal construction of a digital government is an important force for promoting the modernization of the national governance system and governance capacity. At present,some achievements have been made in the construction of digital government in China,but there are still problems such as the legislative system needs to be improved,the insufficient protection of digital human rights,the lack of public data openness,the lack of government-enterprise cooperation mechanisms,and the risks of algorithmic decision-making. In order to ensure the smooth operation of the construction of digital government,it is necessary to analyze the construction of digital government in foreign countries,and then combine the actual situation of China to construct the rule of law for digital government from five aspects:improving the legislative system of digital government,strengthening the comprehensive protection of digital human rights,expanding the degree of openness of government data,improving the system and mechanism of government-enterprise cooperation,and optimizing the methods of algorithm decision-making,so as to promote the further development of China's digital government construction.
