The Formation Mechanism and Countermeasures of Overseas Compliance Risks in Export Control
The characteristics of overseas compliance risks are reflected in the diversity of applicable laws,the heterogeneity of affected groups,and the long-term nature of impacts.The formation mechanisms include five primary triggers:violations of territorial jurisdiction,item jurisdiction,user jurisdiction,usage jurisdiction,and the Foreign Direct Product rule(FDP).To address compliance risks arising from fair export controls,enterprises must to establish robust internal compliance management systems and enhance their compliance capabilities.For compliance risks caused by unfair export controls,enterprises should seek state protection and resolutely safeguard their legitimate rights and interests abroad.
