摘要
网络远程勘验是信息化时代催生的新型电子数据取证手段.网络远程勘验已经在内涵、性质和功能上突破了传统勘验制度的规定,在实践中呈现出强制性侦查措施属性.但相关立法对网络远程勘验的规定粗疏,存在与网络在线提取之间的顺位矛盾,且未对其落实审批程序、缺乏相应的监督和救济程序,导致侦查机关在实践中易产生侵权情形.因此有必要贯彻网络远程勘验审批程序、理清与网络在线提取之间的顺位问题、落实检察机关的监督机制、拓宽被勘验人员的救济途径等,促进网络远程勘验规则体系的有序构建.
Abstract
Network remote inspection is a new electronic data forensics method in the information age.Network remote inspection has broken through the provisions of the traditional inspection system in the connotation,nature and function,and presented the attribute of compulsory investigation measures in practice.However,the relevant legislation has rough provisions on network remote inspection,there is a contradiction with the online extraction,and it does not implement the principle of writ and lack of corresponding supervision and relief procedures.Therefore,it is necessary to carry out the network remote inspection examination and approval procedures,clarify the order between the network and online extraction,implement the supervision mechanism of the procuratorial organ,broaden the relief channels of the inspected personnel,and promote the orderly construction of the network remote inspection rules system.
