契约论视角下人工智能算法专利充分公开的困境与出路

在契约论视角下,公开是专利的基本维度之一,人工智能(AI)算法专利却向充分公开制度提出挑战.AI算法的"黑箱属性"和充分公开的披露要求相矛盾,导致《专利审查指南》规定的"技术特征+有益效果"的算法专利说明书撰写面临严峻困难.公开算法源代码和数据集会泄露既存信息或隐匿信息,从而引发数据安全隐患.AI算法卓越的检索力和创造力会引起"普通技术人员"的界定在逻辑层面发生改变.为践行专利契约论的"公开换保护"理念,遵循专利利益平衡原则,须采取多元手段明确AI算法专利公开的具体内容,根据"人机结合"标准来重塑"普通技术人员"的内涵,并创新性引入专利数据补充制度,从而克服AI算法特性引发的技术公开障碍,最终实现专利制度的本质目的.
The Dilemma and Outlet of Full Disclosure of Artificial Intelligence Algorithm Patents from the Perspective of Contract Theory
From the perspective of contract theory,disclosure is one of the basic dimensions of the patent system,and the patent of artificial intelligence(AI)algorithm challenges the system of full dis-closure.The black-box attribute of AI algorithm contradicts the disclosure requirements of full disclo-sure,but the patent specification drafting requirement of"technical features+beneficial effects"stipu-lated in the Patent Examination Guidelines cannot resolve this contradiction.When the source code and dataset of AI algorithms are disclosed,existing information or hidden information will be leaked,which will cause data security risks.The excellent retrieval power and creativity of AI algorithms will promote the logical change of the connotation of"ordinary technician".In order to practice the concept of"dis-closure for protection"in the patent contract theory and follow the principle of balance of patent inter-ests,it is necessary to adopt multiple means to clarify the specific content that should be disclosed in AI algorithm patents,reshape the connotation of"ordinary technician"according to the standard of"hu-man-machine integration",and innovatively introduce a patent data supplement system in the field of biomedicine,so as to overcome the obstacles to technical disclosure caused by the characteristics of AI algorithms,and finally achieve the essential purpose of the patent system.
