摘要

标准必要专利的侵权纠纷是否适用于禁令救济,这一问题影响着标准必要专利权利人、标准实施人、消费者等多方利益,其中公共利益是法院签发禁令的考量因素之一.然而,当前我国标准必要专利禁令救济理论体系尚不完备,司法实践中存在公共利益主体泛化、内涵不明的问题,缺乏统一标准.美国、德国等主要国家已在许可实践中明确SEP禁令判别的公共利益概念、种类与考量方式.我国应当结合公共利益的阐释性特征,搭建公共利益与标准必要专利禁令救济中群体利益的桥梁,利用利益衡量法与比例原则,分别从最高法院与地方各级法院的角度统一裁判标准,满足公众对司法确定性的需求,实现创新利益与弱势群体利益间的平衡.

Abstract

The applicability of injunctive relief in infringement disputes involving Standard Essential Patents(SEPs)impacts multiple stakeholders,including SEP holders,standard implementers,and consumers,with public interest being one of the factors considered by courts when issuing injunctions.However,the current theoretical framework for SEP injunctive relief in China remains incomplete,and judicial practice reveals issues such as the over-generalization of public interest entities and unclear content,lacking a unified standard.Major countries like the United States and Germany have already clarified the concept,types,and methods of considering public interest in SEP injunction determinations in their licensing practices.China should,therefore,build a bridge between public interest and collective interests in SEP injunctive relief by interpreting public interest characteristics,utilizing interest balancing methods and the principle of proportionality.This approach should unify adjudication standards from the perspectives of the Supreme Court and local courts at various levels to meet the public's demand for judicial certainty,thereby achieving a balance between the interests of innovation and the interests of vulnerable groups.
