Since 1979,the prosecutorial investigation power has experienced an evolutionary development process,with its scope being gradually limited and its nature gradually returning to legal supervision.This feature determines that enhancing the intensity and accuracy of prosecutorial investigation power is an important means to improve the quality and effectiveness of legal supervision.In practice,the application rate of prosecutorial investigation power is low,the transfer mechanism of case clues is not perfect,and there are still problems such as"self-investigation,self-arrest and self-prosecution",which affect the improvement of the strength and accuracy of prosecutorial investigation power.To improve this situation,in terms of concept,we should take the active prosecutorial concept as the guidance;in terms of regulation,we should establish the principle of prosecutorial jurisdiction as the priority of standardization,and moderately ease the conditions of applying the prosecutorial investigation power;in terms of mechanism,we should explore the establishment of prosecutorial investigation department,set up the connection mechanism of case clue discovery and transfer,and improve the accuracy of prosecutorial investigation with the help of digital prosecution.At the same time,we should pay attention to the internal and external supervision and restriction of the prosecutorial investigation power.
