The application of electronic monitoring to minors in juvenile justice is in line with the goal of implementing the criminal policy of"fewer arrests and more careful prosecution and detention"and the criminal justice objective of lenient and diversified punishment.Youth justice in the UK has established a corresponding system and carried out abundant practice in the application of electronic monitoring to minors.In terms of system,the UK youth justice provides that electronic monitoring can be applied in three types of situations:bail,criminal judgment order and non-criminal judgment order.In practice,relying on the"multi-agency cooperation and support"youth justice system,a complete electronic monitoring operation process of"decision-implementation-violation response"has been formed.Taking the good experience and existing problems of youth justice in the UK as reference and taking the Chinese conditions into consideration,this paper suggests that it is necessary for China to make efforts from three levels,namely,concept,system and practice,and expand the application of electronic monitoring to pre-trial non-custodial measures and conditional non-prosecution system for minors.
