The flexible investigation power is a component of the prosecutorial investigation power and an integral part of the prosecutorial organizations to exercise legal supervision authority.The power is also necessary for the prosecutorial organizations to prosecute crime and meets the practical need to restrict power for the prosecutorial organizations.The dilemma of the operation of the prosecutorial flexible investigation power should be tackled by optimizing the path,namely,by defining precisely the characteristics of the power,specifying and expanding the applicable scope of the power,clarifying the initiating conditions of the power,and improving the supervision and restriction mechanism of the power.
