犯罪治理现代化视野下罪犯矫正的目标与路径

罪犯矫正是现代犯罪治理中的关键环节,看似处于已然之罪的治理末端,实则是未然之罪的治理开端.从应对型法治到预防型法治,不仅导致犯罪治理定位的历史性重构,亦使罪犯矫正理念发生系统性变革.犯罪治理现代化决定了新时期的罪犯矫正既要依法而为,更要坚持系统观念,促进量刑与行刑的知识整合与价值融贯.囿于预防型法治形态下的罪犯矫正实践存在行刑畸轻和行刑趋重两类倾向,为促进罪犯矫正的规范化发展,需要在现有的"三阶式"量刑步骤的基础上建构行刑阶段的裁量方法.从责任刑到预防刑的考量顺序,不仅能增强行刑裁量逻辑的可解释性,也有助于促进行刑裁量方法的一致性,进而对克服类案之间的行刑失衡有所助益.
Abstract
Offender rehabilitation is pivotal in modern crime governance,bridging the management of past crimes with the prevention of future ones.The transition from reactive to preventive justice demands a historic repositioning of crime governance and a systemic shift in correctional philosophy.In the new era,it's imperative that correction aligns with the law and embraces a holistic view,integrating sentencing and execution knowledge and values.To standardize correction practices,which often swing between leniency and severity under preventive justice,we must develop discretionary methods in the execution phase,building on the three-stage sentencing model.The approach of considering liability punishment before preventive punishment enhances the logic and consistency of execution discretion,aiding in addressing sentencing imbalances in similar cases.
