非法侵入网络摄像头行为的刑法规制困境及解决路径

摘要
非法侵入网络摄像头行为严重侵犯用户的个人隐私,具有显著的社会危害性.当前司法实践中,认定其成立非法获取计算机信息系统数据罪或者非法控制计算机信息系统罪是司法机关的惯常做法.然而,无论从网络摄像头的工作原理来看,还是从行为的构成要件分析,非法侵入网络摄像头行为均难以完全纳入这两个罪名的规制范围.实际上,非法侵入网络摄像头行为本质上是一种非法侵入计算机信息系统的行为,而我国现行刑法将非法侵入计算机信息系统罪的犯罪对象限定为国家事务、国防建设等特定领域的计算机信息系统.对此,合理的规制路径应当是通过刑事立法,将涉及网络摄像头等个人权益和公共事务的信息系统纳入该罪的保护对象范围.
Abstract
The illegal intrusion into the webcam seriously infringes the privacy of the webcam users,which has significant social harm.In judicial practice,it is common practice to identify it as constituting the crime of illegal acquisition of computer information system data or the crime of illegal control of computer information system.However,whether from the perspective of the working principle of the network camera or from the constituent elements of the behavior,it is difficult to completely match the illegal intrusion into the network camera with the two types of crime.Illegal intrusion into network cameras is essentially an act of illegal intrusion into compuserve,and the object of the crime of illegal intrusion into computer information system in the existing criminal law of China is limited to computer information system in specific areas such as national affairs and national defense construction.Therefore,the reasonable way to regulate this act is to include the information system involving personal rights and public affairs such as webcam into the scope of protected object of this crime through criminal legislation.
