In order to open up business territory,platform enterprises give preferential treatment to their own business in the downstream market by means of data monopoly and traffic blocking,realizing the transmission of competitive advantage and even monopoly position across the market.In essence,the transmission of competitive advantage beyond a certain limit may constitute abuse and does not belong to the scope of legitimate competition.Platform self-preference should be included in the scope of regulation of anti-monopoly law because it meets the common requirements of leverage theory for abusive behavior.However,three factors,namely,the lack of uniform standards for determining the illegality of conduct,the difficulty in determining the anti-competitive effect and the abuse of the justification defense,have blurred the boundaries of the antitrust regulation of self-preferential treatment,so the analysis framework is reshaped to optimize it,clarify the reasonable limits of platform autonomy and indicate the future direction.
